When families argue over a relative's mental capacity, the last thing anyone needs is a lengthy drawn-out battle. But with NHS waiting lists, it could be 2-3 months before you see a consultant psychiatrist.

The assessment begins with a mental state examination, where psychiatrists consider the patient's appearance and behaviour as well as speech, mood, perception and various cognitive functions. Then using the UK's Definition of Capacity (Mental Capacity Act 2005), our experts deliver an assessment based on the following criteria:

 

1. Does the patient understand information relevant to the decision they're making?
2. Does the patient retain that information after a few minutes or hours?
3. Can the patient apply that information or give it a sense of priority?
4. Can the patient communicate their decision in a way that shows an understanding of the alternatives?
